Buscaremos, neste artigo, apontar as diferenças gerais na forma de compreensão do crime e da punição entre um Marx pré-marxiano e um Marx propriamente marxiano. Privilegiaremos, para isso, a análise de textos publicados pelo autor na Gazeta Renana em 1842, em esforço comparativo com obras posteriores, situadas entre 1844 e 1853.

Os últimos anos foram marcados pelo crescimento notável da produção artística/poética em língua de sinais, com a presença cada vez mais efetiva de poetas slamers na cena nacional. O efeito mais direto disso é a vitrinização das interseccionalidade que atravessam as múltiplas identidades surdas, expostas tanto nas performances síncronas das apresentações nos slams, de forma presencial ou virtual, quanto na poesia.doc. A poesia Boneca Invisível utiliza elementos cinematográficos para potencializar sua narrativa e discutir os efeitos mais diretos da violência sofrida (...) por ela, vivido por tantas mulheres, negras, surdas. Fazemos observações de cunho teórico-epistêmico, do feminismo negro em direção ao feminismo negro surdo, e também de interesse prático, que ocupa-se dos meios de produções que são acessados para a composição da poesia surda, suscitando um alargamento conceitual para abarcar textualidades corporais como produções literárias legítimas, além do reconhecimento técnico das ferramentas acionadas e dominadas pela poeta para sua produção textual literária de denúncia. This article approaches different moments of Nietzsche’s cause for the abolition of castigation, identifying a turn from determinist arguments towards a new point of view we have been calling necessitarianism. The idea is that this change is an answer to the realization that value attribution is inevitable, and a new elaboration on the origins of morals, when the philosopher detaches from utilitarian concepts, with consequences for his moral psychology and theory of value. O presente trabalho pretende resgatar o debate entre Richard Rorty e Nancy Fraser, ocorrido no início da década de 1990, especificamente a partir do texto Feminismo e Pragmatismo apresentado na Tanner Lectures on Human Value. Nesta conferência o filósofo discorreu sobre a possibilidade de conciliação entre o seu pragmatismo e o feminismo. Rorty aborda o feminismo enquanto autocriação da mulher através da “redescrição” mediante a manifestação poética, onde o filósofo encara as feministas como criadoras do novo. Em seguida, exporemos a (...) crítica de Fraser, que trabalha sobre a proposta apresentada pelo pragmatista e que oferece suas próprias idéias dentro de uma concepção do feminismo como movimento democrático de massa. Ao final, uma breve avaliação das implicações das críticas e sugestões apresentadas por Rorty ao feminismo e também da resposta de Fraser. (shrink)

Delusion is one of the most intriguing psychopathological phenomena and its conceptualization remains the subject of genuine debate. Claims that it is ill-defined, however, are typically grounded on essentialist expectations that a given definition should capture the core of every instance acknowledged as delusion in the clinical setting.

Resumo Este artigo examina brevemente algumas tentativas de reconstruir o que seria a contrapartida “positiva” da crítica de Nietzsche à moralidade, ou seja, o tipo de engajamento normativo que fundamentaria seu ataque à moral. Essas reconstruções têm atribuído a Nietzsche diferentes compromissos normativos, de modo que ele está próximo ora de um esteticismo, ora de algum tipo de utilitarismo, ora de uma ética das virtudes. Destacamos alguns pontos que são relevantes para a filosofia de Nietzsche e que parecem estar em (...) dissonância com tais reconstruções. Estes pontos referem-se às concepções nietzschianas de perspectivismo, egoísmo, liberdade, Rausch e seu autodeclarado “imoralismo”. O objetivo é avaliar em que medida essas reconstruções são capazes de capturar o que há de singular no que Nietzsche tem a nos dizer sobre ética e normatividade prática sem descuidar de certos compromissos essenciais de sua filosofia.This article discusses some attempts of reconstructing the “positive” counterpart of Nietzsche’s critique of morality, that is, attempts of answering the question of what would be a properly Nietzschean ethics or normativity, which is supposed to ground his attacks on morals. Such reconstructions have attributed different normative commitments to Nietzsche, so that his positive views on ethics might be described either as a form of aestheticism or as a heterodox version of utilitarianism or even as a variety of virtue ethics. We point out some features of the Nietzschean philosophy that seem to be relevant though not consonant with such reconstructions, points related to his conceptions of perspectivism, egoism, freedom and Rausch as well as his self-proclaimed “immoralism”, in order to assess the appropriateness of such reconstructions to capture Nietzsche’s positive views on ethics and practical normativity. Na obra Fenomenologia da percepção, o tema da expressão aparece diretamente vinculado ao tema da percepção. Na medida em que o corpo percebe o mundo conforme uma atitude perceptiva, tal atitude envolve a expressão. O corpo se expressa conforme o movimento perceptivo que realiza no mundo, pois a percepção se faz por meio de uma atitude motora, um gesto, a partir do qual acontece uma prática de habitação e sentido. O corpo percebe situado no mundo sensível, que lhe faz sentido (...) e, na medida em que se comunica com os outros, expressa essa percepção. O que o corpo comunica, antes mesmo das palavras, é a percepção do mundo. A expressão é, então, o gesto com o qual o corpo se comunica no mundo. O corpo expressa a si, ao expressar sua percepção do mundo, pois o corpo tem sentido conforme sua percepção do mundo tem sentido, ou seja, os sentidos do corpo e do mundo são imbricados. O corpo significa para o mundo assim como este significa para aquele, a relação do ser no mundo é significativa e ambígua e a expressão decorre disso. A expressão é a atitude perceptiva manifesta intersubjetivamente; é a expressão do ser no mundo. Assim, o presente artigo busca desdobrar tais noções a fim de apresentar uma compreensão do vínculo dos temas da percepção e da expressão nesse momento da filosofia de Merleau-Ponty. (shrink)

In this article, I investigate to what extent future generations that belong to language minorities are entitled to group rights that protect their linguistic identity. In particular, I assess whether these future generations are entitled to assistance rights, symbolic claims, self-government rights and exemptions from the law. To address this I outline three arguments supporting group rights for current generations and raise the question of whether these arguments, which are true for current generations, will also be true for future generations. (...) The answer defends the entitlement of future generations to group rights against two counterarguments. The first is that future generations have no interest in preserving their language and therefore there is no normative justification for group rights. The second is that there is a duty to eliminate group rights in order to avoid malign consequences of these rights for future generations. (shrink)

AimTo evaluate the cognitive functioning of subjects practicing trance mediumship in Brazil.MethodThe study was based on the measurement of cognitive functions of 19 spirits mediums through neuropsychological tests such as the Brief Cognitive Screening Battery, the Verbal Fluency Test, the digit span test, the cube test, the five digit test and an evaluation of mental health through scales such as the Beck Depression Inventory, the Self-Report Questionnaire, and the Trauma History Questionnaire. The sample included the participation of spirit mediums divided (...) into two groups. The more experienced group with 11 subjects had more than 10 years of mediumistic practice, while the other less experienced group with 8 subjects had 1–5 years of experience. The inclusion criteria were psychophonic mediums with regular trance practices for at least one year. The data collected were analyzed using the SPSS statistical package.ResultsRegarding performance on the BCSB and digit span test, all subjects reached scores at the median or higher in comparison to standardized scores of Brazilians. Scores of 90% on the cube test and 42% on the FAS were reached in comparison to median or higher values, versus the median of standardized scores among Brazilians. On the FDT, we found statistical significance in the choice stage, with higher performance of subjects whose initial age of trance recognition occurred before 21 years old. On the BDI scale, no participant met the criteria for major depression. The SRQ showed an incidence of common mental disorders in 21% of the sample, which was more prevalent in the LEG.ConclusionThe cognitive functioning of subjects who practice trance mediumship in Brazil is associated with cognitive health. Executive dysfunction may be a tendency in LEG. However, an incidence of common mental disorders in the LEG was observed. Executive processing was higher in the subgroup with early practices of recognizing the phenomenon. (shrink)

O presente trabalho tenta resgatar a memória do poder soberano, período que predominou o suplício, passando pelo poder disciplinar na visão de Michel Foucault, chegando ao período do regime militar no Brasil. Traz como objetivo procurar identificar como é o comportamento de cada indivíduo com relação ao poder, além de buscar uma delimitação da docilização, como algo permanente em toda história da humanidade, focando principalmente nos eventos acima mencionados. Utilizamos como metodologia as obras do autor “Vigiar e Punir ”, “Microfísica (...) do poder ”, além de alguns textos relacionados, para o bom desenvolvimento do tema em causa. Finaliza-se o poder soberano para entrar em cena o poder disciplinar. Enquanto o primeiro almeja o corpo dos indivíduos, o segundo visa controlar a mente. A disciplina promove a individualização, com o intuito de adestrar cada sujeito da sociedade. Pesquisamos como uma melhor compreensão de como se originou, onde todo o poder surgiu e sua aceitação perante os indivíduos em sociedade. Antes de chegarmos a esses resultados, analisamos os pontos semelhantes em ambos os períodos. Ressalvamos que se trata de uma pesquisa, com dados iniciais, no que tange aos estudos da problemática em questão. (shrink)

Taking into account the debate about the continuity or discontinuity in Heb 1-12 and Heb 13, with the implication of whether the hortatory material in chapter 13 is consistent with chapters 1-12 or it is a list of miscellaneous exhortations instead, this article seeks to discern connections between the concept of marriage in 13:4 with the ideas stated in 12:28–13:6. This endeavor is informed by a reading of 12:28-13:6 made in three steps. First, 12:28-29 is read as a transition for (...) the hortatory material in chapter 13. Second, 13:1-6 is traced as a conceptual structure for the understanding of marriage in 13:4. Third, the article identifies connections of the exhortation about marriage in 13:4 with ideas developed in 12:28-29 and 13:1-6. (shrink)

The Portuguese animal rights movement has been extremely active in campaigning against bullfighting. Indeed, from 2002 to 2014, this was their main priority in terms of campaigns. In this article, I assess how these campaigns have been carried out, arguing that the animal rights movement in Portugal has been othering supporters and practitioners of bullfights in their campaigns. In other words, their campaigns have consisted of drawing a sharp contrast between bullfight supporters and practitioners and the rest of the population. (...) I argue that a consequence of this is that the speciesist practices of the majority of Portuguese have become normalised; consequently, leading to the reinforcement of some speciesist norms. The objective with this study is highlight the thesis of organic and dynamic continuity of the intellectual production of Jean-Paul Sartre from the conception of history and the ethical implications that flow from it. This work will look on the fictional production of philosopher, particularly his novels, for the purpose of evidencing such thesis.

Ethics has powerful teeth, but these are barely being used in the ethics of AI today – it is no wonder the ethics of AI is then blamed for having no teeth. This article argues that ‘ethics’ in the current AI ethics field is largely ineffective, trapped in an ‘ethical principles’ approach and as such particularly prone to manipulation, especially by industry actors. Using ethics as a substitute for law risks its abuse and misuse. This significantly limits what ethics can (...) achieve and is a great loss to the AI field and its impacts on individuals and society. This article discusses these risks and then highlights the teeth of ethics and the essential value they can – and should – bring to AI ethics now. (shrink)

In his thesis 'Para uma Teoria Geral dos Homomorfismos' (1944) the Portuguese mathematician José Sebastião e Silva constructed an abstract or generalized Galois theory, that is intimately linked to F. Klein’s Erlangen Program and that foreshadows some notions and results of today’s model theory; an analogous theory was independently worked out by M. Krasner in 1938. In this paper, we present a version of the theory making use of tools which were not at Silva’s disposal. The emergence of environmental governance practices raises a fundamental question as to whether they are substantive or symbolic. Toward that end, we analyze the relationship between a firm’s environmental governance and its environmental management as reflected in its ultimate outcome, environmental performance. We posit that substantive practices would bring changes in organizations, most notably in terms of improved environmental performance, whereas symbolic practices would portray organizations as environmentally committed without making meaningful changes to their operations. Focusing on a sample of (...) environmentally sensitive firms, results are consistent with environmental governance mechanisms being predominantly part of a symbolic approach to manage stakeholder perceptions on environmental management, having little substantial impact on organizations. Statistical analyses show mostly that there is no relation between environmental governance mechanisms and environmental performance, measured in terms of regulatory compliance, pollution prevention, and environmental capital expenditures. However, there is some indication that environmental incentives are associated with pollution prevention. Interviews with corporate directors shed further light on these results by underlining that environmental governance mechanisms are employed at the board level to protect the organization from reputational and/or regulatory harm, but are not necessarily intended to proactively improve environmental performance. This book focuses on multiculturalism, racism and the interests of nonhuman animals. Each are, in their own right, rapidly growing and controversial fields of enquiry, but how do multiculturalism and racism intersect with the debate concerning animals and their interests? This a deceptively simple question but on that is becoming ever more pressing as we examine our societal practices in a pluralistic world. Collating the work of a diverse group of academics from across the world, the book includes writing on (...) a wide range of subjects and addressing contemporary issues in this critical arena. Subjects covered include multiculturalism, group rights and the limits of tolerance; ethnocentrism and animals; racism and discrimination and non-Western alternatives to animal rights and welfare. The book will be of interest to researchers, lecturers and advanced students as well as range of social justice organisations, government institutions, animal activist organisations and environmental groups. This case study analysis looks at Portuguese policy during the COVID‐19 pandemic whereby convicts were freed for the sake of public health. I defend this policy negatively by refuting the argument that suggested it involved various forms of injustice.

This paper investigates epistemological and ethical implications of the growingavailability of direct-to-consumer genetic testing for the science and society. Direct-toconsumer genetic testing is characterized as the genetic testing sold directly to consumerswithout any assistance from professionals. By offering empowerment and control, companiesconvince consumers to sequence their genome by granting the company access to theirgenetic data in exchange to results that are not always accurate. To which extent doconsumers properly understand the results of their genetic testing? Are consumers aware ofthe possible (...) implications for disclosing genetic information to private companies? I addressthese questions in two steps: firstly, I discuss epistemological implications of thedevelopment of Genomics, understood as a data-intensive science, by delving into thetheoretical commitments of the concept of gene and the notion of circular causality.Secondly, I reflect upon the privacy risks of taking direct-to-consumer genetic testing in adata-rich world. Finally, I draw some conclusions on the possible consequences of direct-toconsumer genetic testing by suggesting key-concepts that may help to clarify the limits andscope of genetic testing. This article aims to present the utopia in the aesthetic horizon of Ernst Bloch and T. W Adorno, from the dialectical approach of Principle Hope and Aesthetic Theory. We started from the origin and deployments of the concepts of Pre-appearance and Enigma and their connections to utopia. The pre-appearance notion is closely linked to daydreams which are art modelers. As art modelers, daydreams anticipate a better world which art anticipates by the Pre-appearance of the visible. In Adorno, we start from (...) the relationship between the content of truth and Enigma to find a link between that relationship and the utopia. So, our interpretative hypothesis is that in the aesthetic horizon Bloch and Adorno utopia approaches these two philosophers. (shrink)

This papers’ goal is to present a survey of the contemporary discussions regarding truthmakers. The emphasis will be on the characterization of the truthmaking relation and on the problems involved in universal propositions and negations.

Published in 1908, C.S. Peirce’s ‘A Neglected Argument for the Reality of God’ is one of his most difficult articles. Presenting a peculiar entanglement of scientific method and theology, it sketches a ‘humble’ argument for the reality—and not the existence—of God for Musers, that is, those who pursue the activity he calls ‘Musement’. In Musement, Peirce claims, we can achieve a kind of perception of the intertwinement of the three universes of experience: of feeling, of brute fact, and of reason. (...) He also somehow relates each universe to a distinct phase of inquiry, which is described by the use of induction, deduction, and abduction or retroduction. The way that he develops his claims allows him to outline God as an abductive vague hypothesis to explain how those three universes make up a single whole. The hypothesis being vague means that the principle of contradiction does not hold for it. In this presentation, we aim at throwing some light at these points, focusing on the concept of Musement and what is understood as the vagueness of the hypothesis. (shrink)

The aim of this paper is to investigate the relationship between information and abductive reasoning in the context of problem-solving, focusing on non-human animals. Two questions guide our investigation: What is the relation between information and abductive reasoning in the context of human and non-human animals? Do non-human animals perform discovery based on inferential processes such as abductive reasoning? In order to answer these questions, we discuss the semiotic concept of information in relation to the concept of abductive reasoning and, (...) more specifically, to the notion of manipulative abduction proposed by Magnani. Finally, we investigate a case study of corvids’ intelligence, namely, their capacity of causal cognition. (shrink)

After satisfying their quantitative and qualitative needs as regards nutrition, consumers in developed countries are becoming more involved in the ethical aspects of food production, especially when it relates to animal products. Social demands for respecting animal welfare in housing systems are increasing rapidly, as is social awareness of human responsibility towards farm animals. Many studies have been conducted on animal welfare measurement in different production systems, but the available information for small ruminants remains insufficient. In this study, a 75 (...) criteria-evaluation tool has been set up on the basis of the five freedoms concept. Animal welfare considerations have been analyzed in 25 documents, including labeling schemes, regulations, and recommendations from different European countries. The results show many differences between regular and organic small ruminant farming standards. Emergency measures are generally lacking. A weak representation of psychological aspects of animal welfare, especially by the current European legislation, is highlighted. (shrink)

The COVID-19 pandemic requires emergency policies to be put in place in order to avoid a global health catastrophe. At the same time, there has been an increasing preoccupation that argues urgent policies for public health neglect social justice. By looking at Portugal’s successful confinement case during the early stages of the pandemic, I argue that ethically driven social justice policies are not just compatible but also an instrumentally important element in addressing this pandemic in an effective way. The Portuguese (...) case study suggests that enhancing social justice towards socio-economically vulnerable groups correlates with the prevention of the spread of COVID-19; these benefits to public health can be explained by the fact that those policies create social distancing and less exposure to the COVID-19 virus and other contagious diseases and also remove disincentives to the use of healthcare services. O artigo versa sobre considerações acerca do direito natural, destacando primeiramente a iniciativa, datada do final no século XIX, de retomá-lo como seara jurídica, na forma de uma disciplina a ser considerada nos estudos do direito e como parte efetiva do ordenamento jurídico. A seguir, baseando-se em doutrinas típicas do positivismo, serão analisados argumentos contrários à consideração efetiva do direito natural, procurando-se demonstrar sua inconsistência.

The COVID-19 pandemic has brought significant challenges to healthcare systems worldwide, and in Africa, given the lack of resources, they are likely to be even more acute. The usefulness of Traditional African Healers in helping to mitigate the effects of pandemic has been neglected. We argue from an ethical perspective that these healers can and should have an important role in informing and guiding local communities in Africa on how to prevent the spread of COVID-19. Particularly, we argue not only (...) that much of the philosophy underlying Traditional African Medicine is adequate and compatible with preventive measures for COVID-19, but also that Traditional African Healers have some unique cultural capital for influencing and enforcing such preventive measures. The paper therefore suggests that not only given the cultural context of Africa where Traditional African Healers have a special role, but also because of the normative strength of the Afro-communitarian philosophy that informs it, there are good ethical reasons to endorse policies that involve Traditional Healers in the fight against COVID-19. We also maintain that concerns about Traditional African Healers objectionably violating patient confidentiality or being paternalistic are much weaker in the face of COVID-19. (shrink)
